Terms & Conditions – Photography Prints
These Terms & Conditions apply to purchases of photographic prints from Martin Steele Photography (“we”, “us” or “our”).
By placing an order with us, you agree to these Terms & Conditions.
1. Our Products
Our photographic prints are produced to order. Customers may select the photograph, size, and other options available when placing an order.
As prints are produced specifically following the customer's order, they may constitute bespoke or personalised goods.
Please note that colours and appearance may vary slightly between the image displayed on your device and the finished printed product due to differences in screens, monitors, lighting and printing processes.
2. Placing an order
Please check your order carefully before completing your purchase, including the selected photograph, size, finish, quantity and delivery address.
Once an order has been accepted and production has commenced, we may be unable to make changes to the order.
Payment must be received in full before an order will be processed.
3. Delivery
We aim to produce and deliver your order within 14 days of receiving payment.
The 14-day period is an estimated delivery timeframe rather than a guaranteed delivery date. Every order is produced by an external print lab. Occasionally, delivery may take longer due to circumstances outside our reasonable control, including postal or courier delays, technical problems or other unforeseen circumstances.
If your order has not arrived within the expected timeframe, please contact us and we will investigate the matter.
4. Bespoke and Made to Order prints
Our prints are produced specifically in accordance with the options selected by you when placing your order.
Where a product is genuinely bespoke or personalised to your specifications, you may not have a statutory right to cancel the order simply because you have changed your mind, where the law provides an exception for such goods.
Accordingly, we do not generally accept returns or cancellations for bespoke or personalised prints where the print has been produced to your specific requirements.
However, this does not affect any statutory rights you may have. If a print is faulty, damaged, incorrectly supplied or does not conform to the contract, you may be entitled to a repair, replacement, refund or other remedy under applicable consumer law.
5. Faulty, damaged or incorrect prints
We take care to package prints securely, but damage can occasionally occur during delivery.
If your print arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible, providing details of the problem and, where appropriate, photographs of the print and packaging.
We will assess the issue and, where appropriate, offer a replacement, repair, refund or other remedy in accordance with your statutory rights.
Nothing in these Terms & Conditions affects your legal rights under the Consumer Rights Act 2015 or other applicable consumer protection legislation.
6. Cancellations
Where the law gives you a statutory right to cancel an order, that right will apply unless a lawful exception applies.
For bespoke or personalised photographic prints, the statutory cancellation right may not apply where the relevant legal exception for personalised or made-to-order goods applies.
If you wish to cancel an order, please contact us as soon as possible. If production has not yet begun, we will consider whether the order can be cancelled.
7 Copywrite and intellectual property
All photographs, images, artwork and associated content remain the intellectual property of Martin Steele Photography unless otherwise stated.
Purchasing a photographic print does not transfer copyright or ownership of the underlying photograph to the customer.
The print is purchased for personal use only unless we have agreed otherwise in writing.
You may not reproduce, scan, copy, distribute, commercially exploit or resell the photograph or create additional copies of it without our prior written permission.
8. Pricing
All prices are displayed in pounds sterling (£) and include applicable taxes where required.
We reserve the right to change prices at any time. However, changes to our prices will not affect an order that has already been accepted and paid for.
9. Delivery addresses
Customers are responsible for providing an accurate and complete delivery address.
We cannot accept responsibility for delays or additional costs resulting from an incorrect or incomplete delivery address supplied by the customer.
10. Circumstances outside our control
We will not be responsible for delays caused by circumstances outside our reasonable control, including postal or courier delays, severe weather, natural disasters, industrial disputes, technical failures or other unforeseen circumstances.
Where such circumstances occur, we will take reasonable steps to keep you informed and to complete your order as soon as reasonably possible.
11. Privacy
We will handle your personal information in accordance with our Privacy Policy.
